Policy statements clarify provisions of Oregon's environmental cleanup statute and rules. These documents are advisory only and are intended to assist DEQ staff, responsible parties, consultants and others implementing cleanup projects.

    When a party conducts a Remedial Investigation and Feasibility Study (RI/FS) under a Consent Order with the Department of Environmental Quality (DEQ), the Consent Order will include an RI/FS Scope of Work (SOW). The SOW describes the elements and work that must be included in the RI/FS. The Consent Order and the SOW are tailored to the specific site for which they are to be used, through discussions with the performing party. However, there are two “boilerplate” versions (short and long) that DEQ staff may use as a starting point for developing a site-specific document. DEQ staff determines which boilerplate SOW is appropriate for use at a particular site based on the complexity or history of the site or other circumstances.

Note: The site-specific document as finally developed may be different than either of the “boilerplate” versions. Also, the requirements for an RI/FS are specified in DEQ’s rules and guidance and will apply to the RI/FS regardless of which version of the SOW is used.

Hazardous waste policies are intended as guidance for Oregon Department of Environmental Quality (DEQ) employees. The policies do not constitute rulemaking by the Oregon Environmental Quality Commission (EQC) and may not be interpreted to create a right or benefit, substantive or procedural, enforceable by law or in equity, by any person. DEQ may take action at variance with these policy statements.

  • Current Report:
    • Rigid Plastic Container 2007/2009 Recycling Report
      This report, issued December 30, 2008, offers the most recent data on rigid plastic container recycling in Oregon, and presents the determination that the aggregate recycling rate for rigid plastic containers for compliance purposes will be above 25% in 2009.
  • Past reports and presentation:
    • Rigid Plastic Container 2006/2008 Recycling Report
      This report was issued December 31, 2007 and offered the most recent data on rigid plastic container recycling in Oregon, and presented the determination that the aggregate recycling rate for rigid plastic containers for compliance purposes would be above 25% in 2008.
    • Presentation January 8, 2008: Oregon Rigid Plastic Container Recycling 2006/2008
      This presentation included information on the 2008 recycling rate, recycling rate trends since the law became effective, disposal, and factors affecting future recycling rates for plastic containers.
    • Supplemental Report: Rigid Plastic Container 2005/2007 Recycling Report Supplement
      This supplement to the 2005/07 report, issued June 20, 2007, revises the determination made in the original Rigid Plastic Container 2005/2007 report based on new data and finds that rigid plastic containers will be recycled at above 25% in 2007.
