Environmental Justice - state laws and policyOregon’s 2008 Environmental Justice Law DEQ’s Environmental Justice Policy DEQ’s State-Tribal Government Relations Oregon’s 2008 environmental justice lawOregon’s environmental justice law, established in 2008, requires state natural resource agencies – including DEQ and 13 other agencies – to follow prescribed steps to provide greater public participation and ensure involvement of people who may be affected by agency actions. Senate Bill 420, which created the law, also created an Environmental Justice Task Force.
The law further directs the natural resources agencies to take the following actions to ensure greater public participation:
Lastly, the law requires natural resource agency directors, and other agency directors as the governor may designate, to report annually to the Environmental Justice Task Force and governor on agencies’ efforts to address environmental justice issues, increase public participation of individuals and communities affected by agencies’ decisions, determine the effect of the agencies’ decisions on traditionally under-represented communities, and improve plans to further the progress of environmental justice in Oregon. principles for making environmental equity inherent in the way the
agency does business and implementation measures that continue to guide
DEQ’s work today. DEQ’s State-Tribal RelationsDEQ developed a Tribal Government-to-Government relations program in 1996 following Governor Kitzhaber's signing of Executive Order 96-30, directing state agencies to develop and maintain strong relationships with Oregon’s nine federally-recognized tribes. In 2001, the Oregon Legislature approved Senate Bill 770 to institutionalize the executive order in state law. Shortly thereafter, DEQ adopted a Statement of Intent(PDF) expressing DEQ’s commitment to maximize inter-governmental relations between the agency and tribal nations. Measures include:
